1. Acceptance of Terms

By creating an account and using Whinta’s WhatsApp Business API platform (“Services”), you agree to comply with and be bound by these Terms of Service, our Privacy Policy, and all applicable policies. If you do not agree, please do not use our Services.

2. Service Description

Whinta provides businesses with access to the WhatsApp Business API through a secure, scalable platform enabling messaging infrastructure, role-based account management, analytics, and support.

3. Account Registration and Responsibilities

  • Users must provide accurate and up-to-date registration information.
  • Account access is limited to the main account holder and authorized users assigned roles such as managers and agents, with access levels defined by the main account holder.
  • Users are solely responsible for securing their account credentials and controlling access.

4. Use Restrictions and Compliance

  • You must not use the Services to send spam, unlawful, misleading, or harmful content.
  • Such misuse may result in your WhatsApp Business API being banned or restricted by Meta (WhatsApp).
  • No refund will be provided if your API access is restricted or banned due to violations.
  • You are solely responsible for using the Services responsibly and in compliance with all laws and WhatsApp policies.

5. Data Privacy and Security

Whinta handles user data in accordance with its Privacy Policy.

We do not collect or store your account credentials.

Data collected is used to deliver and improve Services and comply with legal requirements.

6. Fees and Payment

Use of the platform is subject to payment as per your selected pricing plan.

Non-payment may result in suspension or termination of Service.

7. Suspension and Termination

Accounts violating these Terms or WhatsApp policies may be suspended or terminated immediately.

Accounts without an active valid plan for three consecutive months will be marked dormant and may undergo data deletion.

8. Use of Services

You acknowledge and agree that Whinta’s Services are provided on an “as is” and “as available” basis without any guarantees or warranties, express or implied, including but not limited to warranties of uninterrupted service or suitability for a particular purpose.

While Whinta strives to maintain reliable and secure Services, technical issues, interruptions, or unforeseen events beyond our control may occur. Whinta disclaims any liability for damages or losses arising from such events, including direct, indirect, incidental, consequential, or punitive damages.

Your use of the Services constitutes acceptance of these terms, and Whinta shall not be held responsible for any adverse effects related to your use of the platform.

9. Indemnification

You agree to indemnify and hold Whinta harmless from any claims, damages, or expenses arising from your misuse of the Services, violation of these Terms, or infringement of any third-party rights.

10. Modifications

Whinta may modify these Terms at any time. Continued use of the Services after modifications implies your acceptance of the updated Terms.
